Data Usage

Scope. This section applies to all images, photographs, and related metadata that you upload to Headshot.vip ("Uploaded Photos") as well as the AI-generated outputs produced for you by our service ("Generated Headshots").

Purpose limitation. We process Uploaded Photos solely for the purpose of generating the headshots you request and for delivering, displaying, and allowing you to download those results. We do not use Uploaded Photos or Generated Headshots for model training, model improvement, dataset creation, marketing, advertising, or any secondary purpose outside of providing the requested service.

No third-party sharing for unrelated purposes. We do not sell, rent, or otherwise disclose Uploaded Photos or Generated Headshots to third parties for their independent use. Any sub-processors we engage (e.g., secure hosting or CDN providers) are bound by written agreements and may only process data on our documented instructions and only to support delivery of the service.

Security measures. We implement administrative, technical, and physical safeguards appropriate to the nature of the data, including encryption in transit (TLS), access controls on a least-privilege basis, and segmented environments for image processing. Access to image data is restricted to automated systems except where human access is strictly necessary to investigate a support ticket, abuse, or security event, in which case access is logged and time-bound.

No training or reuse. Uploaded Photos and Generated Headshots are never used to train, fine-tune, evaluate, or otherwise improve AI models, nor are they incorporated into internal datasets or benchmarks.

Data Retention & Deletion

Standard retention window. Unless you choose to save items to your account, Uploaded Photos and Generated Headshots are automatically deleted within 24 hours of processing completion.

Immediate deletion upon request. You may request deletion of your Uploaded Photos and/or Generated Headshots at any time. Upon receiving a verified request (see "User Rights" below), we will delete the specified content without undue delay, typically within 72 hours.

Account-level deletion. If you delete your account, we will delete or irreversibly anonymize personal data associated with your account, including images stored within it, subject to the limited exceptions below.

Limited exceptions. We may retain minimal data for a longer period only to the extent necessary to:

comply with applicable laws, court orders, tax or accounting obligations;

detect, investigate, or prevent fraud, abuse, or security incidents;

enforce our Terms of Service or protect the rights, property, or safety of Headshot.vip, our users, or the public.

Such retained data, if any, is minimized (e.g., timestamp, hashed identifiers, or transaction records), segregated, and not used for model training or any unrelated purpose.

Backups and technical latency. Due to routine backups and distributed caching, deleted items may persist in encrypted backups for a limited period (typically up to 30 days) before being overwritten as part of scheduled cycles. Backup copies are not actively processed and are protected by the same security controls.

User Rights

Subject to applicable law (including GDPR, CCPA/CPRA, and other regional privacy laws), you may exercise the following rights regarding your personal data processed by Headshot.vip:

Right of access. Request confirmation whether we process your personal data and obtain a copy of relevant data that we hold about you, including Uploaded Photos or Generated Headshots still within the retention window.

Right to deletion ("erasure"). Request deletion of your Uploaded Photos, Generated Headshots, and associated personal data. We will honor verified deletion requests without undue delay, subject to the limited legal or security exceptions described above.

Right to correction. Request correction of inaccurate or incomplete personal information associated with your account (e.g., contact details). (Note: images already deleted or auto-purged cannot be corrected and would require a new upload.)

Right to data portability. Request an export of your Generated Headshots and certain personal data in a commonly used, machine-readable format, where technically feasible.

Right to withdraw consent (where applicable). Where processing relies on consent, you may withdraw it at any time. Withdrawal will not affect the lawfulness of processing performed before withdrawal and may limit our ability to provide the service.

Right to object or restrict processing. In certain circumstances, object to or request restriction of processing that is not strictly necessary to provide the requested service.

How to submit requests. To exercise your rights, contact us at [email protected] from the email associated with your account and describe your request with sufficient detail (e.g., relevant timestamps or filenames). We may take reasonable steps to verify your identity (e.g., email confirmation) before acting on the request. We aim to respond within 30 days, or sooner where required by law.

Appeals and supervisory authorities. If you believe we have not addressed your request, you may appeal directly to us at the same email address. You also have the right to lodge a complaint with your local data protection authority where applicable.

Commercial Rights

Your ownership. You retain full ownership and all intellectual property and commercial usage rights in and to the Generated Headshots created for you via Headshot.vip, to the fullest extent permitted by law.

Permitted uses. You may use, reproduce, modify, publish, distribute, and commercialize your Generated Headshots for professional, marketing, or personal purposes (e.g., LinkedIn profiles, company websites, resumes, press materials), without attribution to Headshot.vip unless you choose to provide it.

No claims by Headshot.vip. Headshot.vip does not claim any ownership, exclusive license, or continuing rights of use in your Generated Headshots or Uploaded Photos. We will not use your images for advertising, case studies, model training, or any other purpose without your explicit, prior, written consent.

Third-party content and rights. You are responsible for ensuring that any Uploaded Photos do not infringe the rights of others and that you have the necessary permissions to upload and process them. Headshot.vip may reject or delete content suspected to violate rights or applicable laws.
